Terms of Service

By creating an account you agree to these terms. PayStub is provided "as is" with the warranties set out below.

1. The service

PayStub provides payroll calculation and paystub generation software. It is not a tax-filing service, an ACH money-transmitter, or a substitute for legal/tax counsel.

2. Your account

You are responsible for the accuracy of the data you provide and for the actions taken under your account. You must maintain the confidentiality of your credentials. We require MFA enrollment for accounts with payroll-issue permissions starting on the date you enable it in settings.

3. Payment

14-day free trial, then $40/month base + $6 per active worker per month, billed monthly in arrears via Stripe. "Active" means a worker received at least one issued paystub during the billing cycle. Past-due accounts may have payroll issuance suspended until paid.

4. Acceptable use

You may not use PayStub to facilitate fraud, evade taxes, misclassify workers, or violate any applicable wage law. We may suspend accounts that do.

5. Liability

We are not liable for tax penalties, fines, missed filings, or wage disputes. You are responsible for verifying paystub correctness before issuing, submitting taxes to the IRS / EDD, and complying with all wage laws.

Our maximum liability is the fees you paid us in the prior 12 months. This excludes gross negligence, fraud, or willful misconduct on our part.

6. Termination

You may cancel at any time from the Stripe Customer Portal. We may terminate for breach of these terms. After termination, data is retained per the privacy policy.

7. Changes

We may update these terms. Material changes get email notice 30 days before they take effect.

8. Governing law

California law. Disputes resolved in San Francisco County or via binding arbitration per the AAA Commercial Rules at your option.
